Eligibility: Yächtley Crëw Social Giveaway (“Promotion”) is open only to those who are, as of the date of entry, (i) legal residents of the United States, (ii) at least eighteen (21) years of age, (iii) are a verified member of Club Serrano rewards program in good standing with a valid email address on file (membership is free and can join at any Club Serrano Rewards Center, including at Palms Casino Resort) (hereafter “Entrant”). Employees, officers, directors, representatives and agents of FP Holdings, LP d/b/a Palms Casino Resort (“Sponsor”) and its parent companies, subsidiaries, and affiliates along with Yachtley Crew, LLC (collectively, with Sponsor, “Released Parties”), and their immediate family members (regardless of where they reside) and those living in the same household of each, are not eligible to participate or win a prize. Void where prohibited or restricted by law. Entry submission constitutes your unconditional acceptance to these Official Rules. Odds of winning depend on the number of eligible entries received.

How to Enter: The Promotion begins on May 1, 2024, at 10:00 a.m. Pacific Time (“PT”) and ends May 3, 2024, at 10:00 a.m. PT (the “Promotion Period”). During the Promotion Period, you may participate in the Promotion via the entry method below (“Entry”):

Instagram: Visit Sponsor’s Official Instagram page (Instagram.com/palms or @palms, find Palms’ “Yachtley Crew Giveaway” call for entries post(s), (i) like that post, (ii) leave a comment in that Instagram post that tags a friend (21+) and provide your favorite “yacht rock” song. You must also be following Sponsor’s Instagram account (@palms).

This Promotion is in no way sponsored, endorsed, or administered by, or in association with, Facebook, Twitter or Instagram. Entries must comply with applicable social media platform’s terms & conditions.

Conditions: Limit of one (1) Entry per person, during the Promotion Period, regardless of the method of entry. If more than one (1) Entry is submitted per person, Sponsor will only consider the first Entry submitted.  Incomplete Entries or Entries submitted by Entrants who do not meet the eligibility requirements will be void. Each Entry must be manually entered by the individual Entrant; use of automated technology or similar devices are prohibited. All Entries become the sole property of the Sponsor and will not be acknowledged or returned.

By participating, each Entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Sponsor, which shall be final and binding in all respects, subject to Nevada Revised Statutes $463.362. Released Parties are not responsible for late, lost, stolen, incomplete, misdirected, delayed, garbled, damaged, illegible, inaccurate or undelivered entries; or for any other mechanical, technical or human error of any type whatsoever. Sponsor reserves the right, in its sole discretion, to void any Entries or Entrants and disqualify such Entrants whom Sponsor believes have attempted to tamper with or impair the administration, security, fairness or proper play of this Promotion and/or who are in violation of these Official Rules.

Selection & Notification of Potential Winner: The potential winner will be selected at a reasonable time after the Promotion Period in a random drawing from all eligible Entries received by Sponsor. Entrants need not be present to win. Sponsor will direct message the potential winner (“Potential Winner(s)”) on Instagram to notify them that they are a Potential Winner and provide contact instructions. Each Potential Winner must then contact Sponsor using the provided contact instructions within two (2) days of notification.

Potential Winners are subject to eligibility verification and compliance with these Official Rules. Each Potential Winner may be required to execute and return an Affidavit of Eligibility, which includes releases of liability and publicity, within two (2) days of issuance of notification. Each Potential Winner may be required to provide a valid, government-issued form of identification that matches the name under which the Potential Winner entered. If a dispute arises over entitlement to a prize, the winner is the person to whom the applicable social media account is assigned. Noncompliance with the foregoing or with these Official Rules, or any notification not being successful or being returned as non-deliverable, may result in disqualification of the Potential Winner and, at Sponsor’s discretion, an alternate potential winner will be selected. Accepting the Prize (as defined below) constitutes permission to use a Prize Winner’s (as defined below) name, likeness, and other biographical information for advertising and promotional purposes without compensation or notice to the extent permitted by law.

Prize(s):  Sponsor will award the winning Entrant (“Prize Winner”) one (1) grand prize consisting of: a two (2) night stay in a Standard Room at Palms Casino Resort May 10 – 12, 2024, (1) $300 Food & Beverage credit redeemable at any venue at Palms Casino Resort, and two (2) tickets to see Yachtley Crew on May 11, 2024 at Palms Pool valued.  (“Prize(s)”).   Approximate Retail Value (“ARV”) of Prize(s) is/are $550. The Prize Winner will be solely responsible for all federal, state and/or local taxes, and for any other fees or costs associated with the Prizes they receive. No cash redemption or Prize substitution allowed, except by the Sponsor, who reserves the right in its sole discretion to substitute cash value or another prize it believes is of equal or greater value. Prize is non-transferable and will be awarded. Prize is awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Total ARV of all Prizes to be awarded in the Promotion is: $550.

Miscellaneous:   The Released Parties shall have no liability and will be held harmless by Entrant for any claim, action, liability, loss, injury or damage to entrant or any other person or entity, including, without limitation, personal injury or death to entrant or any other person or damage to personal or real property, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a prize. Sponsor reserves the right, in its sole discretion, to modify, suspend, and/or terminate this Promotion (or portion thereof) for any reason, SPONSOR RESERVES THE RIGHT TO DISQUALIFY ANY INDIVIDUAL THAT ATTEMPTS TO UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION AND RESERVES ALL RIGHTS AND REMEDIES PERMITTED BY LAW.

Arbitration & Choice of Law: As a condition of participating in this Promotion, Entrant agrees that any and all disputes and causes of action arising out of or connected with this Promotion, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the Streamlined Rules of JAMS and held in Clark County, Nevada. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the substantive laws of the Nevada. Promotion is subject to all other applicable federal, state, and local laws, including NRS §463.362.

Winners List: For the name of the Prize Winner, send a self-addressed, stamped envelope to Palms Casino Resort – “Yachtley Crew Giveaway May 2024,” Attn: Marketing Dept., 4321 W. Flamingo Rd., Las Vegas, Nevada 89103. Requests must be received no later than sixty (60) days after the close of the Promotion Period.
